Terms and Conditions

1. Custom Commissions, Deposits & Payment Terms

1.1 Custom Nature of Goods

All custom 3D printed statues, post-processed models, and painted figures offered by LayerLux are classified as “Special Order / Custom Goods” under Section 20 of the South African Consumer Protection Act (CPA). They are made-to-order according to the specifications provided by the client.

1.2 Deposit & Commencement of Work

  • A 50% non-refundable deposit is required before any print preparation, slicing, 3D printing, sanding, or priming begins.
  • This deposit secures machine allocation time and raw materials (PLA, primers, paints).
  • Once 3D printing or physical preparation has commenced, the 50% deposit cannot be refunded in the event of client cancellation.

1.3 Final Balance & Approval

  • Upon completion of the item, high-resolution photographs and/or video of the final painted product will be provided to the client for digital approval.
  • The remaining 50% balance, plus applicable shipping fees, must be paid in full prior to dispatch. Goods will not be packaged or handed to couriers until payment has cleared in full.

2. Intellectual Property (IP) Rights & Client Representations

2.1 Customer Warranties for 3D Files

When a client submits or requests the printing of a specific 3D file (.STL, .OBJ, etc.):

  • The client explicitly warrants that they hold the necessary rights, licenses, or explicit permissions to print the file for personal use.
  • LayerLux operates strictly as a service provider executing print and finish work on client-provided or authorized digital files.
  • The client agrees to indemnify and hold harmless LayerLux against any third-party copyright or trademark claims arising from the production of the requested 3D file.

2.2 Ownership of Artistic Finishes & Portfolio Usage

  • While the client owns the physical 3D print upon full payment, LayerLux retains all intellectual property rights over the artistic paintwork style, techniques, and photographic media created during the production process.
  • LayerLux reserves the right to capture photos, videos, and process footage of any project to showcase on its official website, social media channels, and portfolio, unless a non-disclosure agreement (NDA) or private commissioning agreement is explicitly agreed upon in writing prior to starting the project.

3. Custom Goods Returns, Cancellations & Guarantee

3.1 Exclusions from Standard Return Rights

In accordance with Section 20 of the CPA and Section 42 of the ECT Act:

  • No “Change of Mind” Returns: Because custom statues are handcrafted to your specific color preferences, scale, and finish, returns or refunds based on a change of mind, personal preference shifts after final photo approval, or buyer’s remorse are strictly not accepted.
  • Cooling-Off Period Exclusions: Standard online consumer “cooling-off” cancellation rights do not apply to custom-made or personalized goods.

3.2 Transit Damage & Defects

We pack every statue using multi-layered protective materials, custom foam, and (where appropriate) magnetic/modular assembly to ensure safe transit.

  • Inspection Upon Receipt: The client must inspect the package upon delivery.
  • Transit Damage Protocol: If an item arrives damaged due to courier transit, you must notify us within 48 hours of delivery with unboxing photos/videos showing both the damaged outer packaging and the broken item.
  • Remedies: If damage is verified to have occurred in transit or represents a material printing defect, LayerLux will, at its discretion:
    1. Repair the affected component free of charge.
    2. Re-print and re-paint the damaged module/section.
    3. Replace the item (client will be required to return the damaged item via courier).

4. Minor Variations & FDM Printing Characteristics

4.1 Handcrafted Nature

Each item is custom printed, sanded, and hand-painted. Minor variations in tone, brush texture, or subtle color gradients between preview renders, digital photos, and physical pieces are an inherent quality of hand-painted art and do not constitute a product defect.

4.2 FDM Material Properties (PLA)

Statues and terrain printed in PLA (Polylactic Acid) must be displayed and stored indoors away from direct, high-heat sources (such as inside a hot vehicle or near heaters), as excessive heat can cause PLA deformation. LayerLux is not liable for structural warping caused by improper client storage or heat exposure after delivery.
